Discriminatory and abusive patterns are magnified in detention contexts, making Lesbian, Gay, Bisexual, Transgender and Intersex (LGBTI) persons who are deprived of their liberty particularly exposed to risks of ill-treatment and even torture. This manual is a direct response to the growing demand for practical guidance on this topic.

This new resource from PRI and the Association for the Prevention of Torture (APT) - Women in detention: a guide to gender-sensitive monitoring - is designed to help bodies monitoring places of detention incorporate a gender perspective into their work and to address the problem of violence against women and girls in detention.

This guide introduces the UN Bangkok Rules and other relevant sources of international law to bodies monitoring places of detention, including National Preventive Mechanisms, and provides guidance on assessing risk factors and making recommendations to improve the protection of women against torture and other cruel, inhuman or degrading treatment or punishment.

Despite recent renewed attention on violence against women, one particularly vulnerable group has so far been ignored: women in prison and women suspected, charged or convicted of a criminal offence, who appear not to fit the stereotype of women as victim. However, w
omen in prison are disproportionately likely to have a history of domestic or sexual abuse, and to find themselves at an even higher risk of falling victim to violence, torture and ill-treatment when detained. At the same time, however, their gender specific needs are recognised to an even lesser extent than in they are in the society 'outside'.

Bodies established to monitor places of detention and to prevent torture and ill-treatment can play a crucial role in strengthening the protection from violence of women and girls in detention and in assessing whether the gender specific needs are being met in places where women are detained.

The guide is available in English and in Russian. This is the first one of a series of three thematic papers covering aspects of detention monitoring which have so far been under-researched and received little attention. The next two papers will look at changing culture in places of detention and at preserving security and dignity and will be published shortly.

PRI and APT have also published a joint blog today to highlight the frequently forgotten issue of violence and abuse against women and girls in the criminal justice system.

Background
Alongside with slavery and genocide, the international community has recognised torture and illtreatment
as impermissible at all times and in all circumstances. Its prohibition is absolute and
found its way into customary law, binding to all states irrespective of whether they are parties to
international treaties codifying the prohibition.
Human rights law has come a long way to contrast the practice of torture and ill-treatment with
detailed safeguards and specialised institutions, responding to factors contributing to torture and
aiming at the establishment of accountability and preventive mechanisms. Numerous conventions
have been adopted at regional and international level to respond to and prevent the practice of
torture and ill-treatment.
Articles 2 and 16 of the UN Convention against Torture (CAT) oblige each State Party to take
effective measures to prevent acts of torture and other cruel, inhuman or degrading treatment or
punishment in any territory under its jurisdiction. Such measures comprise protective, reactive and
preventive elements.

LGBTI persons in detention – or persons perceived as belonging to this group – are in a situation of particular vulnerability, at risk of human rights violations and abuses – including by fellow detainees – throughout the entire criminal justice system.

This week Penal Reform International (PRI) and the Association for the Prevention of Torture (APT) are launching a new thematic paper - LGBTI persons deprived of their liberty: a framework for preventive monitoring, which examines how monitoring bodies can contribute to the prevention of torture and ill-treatment against sexual minorities in detention.

This new paper is part of the Detention Monitoring Tool jointly developed by PRI and APT over the last year. The Tool is designed to provide analysis and practical guidance to support monitoring bodies, including National Preventive Mechanisms, to fulfil their preventive mandate as effectively as possible when visiting police facilities or prisons. 

The Tool contains three further thematic papers, two of which were published earlier this year - Women in detention: a guide to gender-sensitive monitoring and Institutional culture: a framework for preventive monitoring and Balancing security and dignity in detention: a framework for preventive monitoring. It also includes five shorter Factsheets, which are designed to provide practical guidance on how monitoring bodies can focus on a number of systemic issues which are particularly high risk factors for torture and ill-treatment.

The complete Tool will be available in English from 15 November 2013 and in Russian towards the end of the year.

This Tool was made possible by funding from the European Union, and produced under PRI’s three-year project, Strengthening institutions and building civil society capacity to combat torture in nine CIS countries, which aimed to strengthen monitoring mechanisms, including National Preventive Mechanisms, and to develop their capacity to counter torture and ill-treatment.

This paper looks at positive culture change in places of deprivation of liberty from a human rights perspective. People deprived of their liberty are particularly vulnerable to abuse, including torture and other forms of ill-treatment.

Bodies that monitor places of detention play a significant role in preventing torture, by identifying root causes and seeking to reduce the risk of torture occurring. The culture in places of detention is one important systemic factor to be considered in torture prevention efforts.

This resource from PRI and the Association for the Prevention of Torture (APT) is designed to:

  • raise awareness among monitoring bodies of the role of culture in places of detention in the prevention of torture and ill-treatment
  • provide a framework for understanding culture in places of detention
  • outline some common cultural attitudes that can represent risk factors for torture and ill-treatment
  • provide some examples of processes and factors that contribute to positive culture change in places of detention.
