"Legal assistance day” was organized
at the Penitentiary No. 4 (women penitentiary) of the Penitentiary Service
The Citizen’s Labor Rights Protection League
has organized "Legal assistance day” at the Penitentiary No. 4 of the
Penitentiary Service on September 8, 2012.
Two female
lawyers specialized in criminal law and having membership of Bar Association
were involved in providing legal assistance. The lawyer Mr. Sahib Mammadov had
also participated in provision of legal assistance. The lawyers
providing legal assistance were Ms. Ramazanova Aybaniz and Taghiyeva Aida. The legal
assistance was provided in two ways. First there was organized a wide meeting
with participation of all prisoners and legal advises of general character and
awareness raising information were presented. Majority of
prisoners had complained regarding the grant of parole and stressed that the
courts are creating serious obstacles in ensuring this right. The chief
of the penitentiary had given explanation regarding this issue and stated that
there is no problem in the penitentiary regarding this and all the prisoners
are provided with positive reference document. Mr. Sahib
Mammadov informed that he is going to meet with the Minister of Justice
together with the members of the Public Committee on Penitentiary Service
regarding the problem and discuss the issue with him. Later there
was provided individual legal assistance. All the prisoners wishing to get
assistance received individual legal advises and documents were prepared to
them on the place. However,
there was decided to provide sustainable legal assistance to majority of them. 13 persons
applied regarding the problem of defining physical disability and asked for
providing legal assistance to them. There will
be conducted a meeting at the Medical Social Expert Commission of the Ministry
of Labor and Social Protection of Population in upcoming days regarding these
persons and problem is going to be solved. 4 citizens
of Islamic Republic of Iran asked assistance in transferring them to their
country of origin in order to serve the rest of their term. The issue
of preparation of cassation to the Supreme Court and provision of lawyers has
been solved for 2 persons. Advocates were assigned by the CLRPL for this case. There had
been provided advises and assistance regarding property rights, preparation of
documents for female prisoners’ small children, rules of getting material aid
from the state budget during the end of the term. There was
provided legal assistance to 43 persons in total. The work regarding provision
of various legal assistance to 15 of them, including providing an advocate
during litigations and preparing claims to courts will be carried on. The
